These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CrownCity Technologies Ltd ("Company", "we", "us", or "our"), a company incorporated in Ghana, governing your use of the Fefefe platform, website (fefefe.app), mobile applications, and all associated services (collectively, the "Platform").

If you are using the Platform on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.

We may update these Terms at any time. Continued use of the Platform after changes take effect constitutes your acceptance. We will provide at least 30 days' notice of material changes.

To use the Platform, you must:

You must create an account to access most features. You agree to:

We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. Scheduled maintenance, API provider downtime, or force majeure events may affect service availability. We will endeavor to provide advance notice of scheduled maintenance periods.

3.3 AI Model Providers

The Platform integrates third-party AI model providers. The availability and quality of AI-generated content may vary based on these third-party services. We reserve the right to change, add, or remove AI model integrations without notice, while maintaining equivalent service quality.

4.1 Subscription Plans

The Platform offers subscription plans for individual users and businesses, as well as pay-per-generation credit packs. Current pricing is displayed on fefefe.app/pricing and is subject to change with 30 days' notice to existing subscribers.

4.2 Local Currency Pricing

Prices are charged in your local currency:

4.3 Billing & Renewal

• —Subscriptions are billed in advance on a monthly or annual basis.
• — Annual subscriptions are billed as a single payment at the start of the billing cycle.
• — Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• — We will send a renewal reminder at least 7 days before your subscription renews

4.4 Payment Methods

We accept payments through Paystack, which supports mobile money (MTN Mobile Money, Airtel Money, Vodafone Cash), debit/credit cards (Visa, Mastercard), and bank transfers, subject to availability in your country. All payment processing is handled by Paystack and subject to Paystack's terms of service.

4.5 Credits

Credits are non-refundable, non-transferable, and have no cash value. Unused credits expire 12 months from the date of purchase. Credits are deducted per generation based on the complexity and model used, as set out in our pricing schedule.

4.6 Refund Policy

Subscription fees are generally non-refundable. However, we will issue a refund if:

Credit packs are non-refundable once purchased. To request a refund under the above exceptions, contact billing@fefefe.app within 7 days of the triggering event.

5.1 AI-Generated Content Ownership

Subject to your compliance with these Terms and payment of applicable fees, you own the intellectual property rights in the AI-generated content you create using the Platform, to the extent permitted by applicable law. You are solely responsible for ensuring that your use of AI-generated content complies with applicable intellectual property laws.

We do not claim ownership over the output content you generate. However, you grant us a limited, royalty-free, worldwide license to:

• — Store, cache, and deliver your generated content to you through the Platform.
• — Use anonymized, aggregated representations of platform-wide content patterns to improve our AI systems (unless you opt out as described in the Privacy Policy).
• — Display your content in our marketing materials if you give us separate explicit written consent.

5.2 Your Input Content

When you upload images, videos, or other content to the Platform as input for AI processing, you represent and warrant that:

• —You own the content or have all necessary rights and licenses to upload and use it.
• —The content does not infringe any third party's intellectual property, privacy, or other rights.
• —The content complies with these Terms and all applicable laws.

5.3 Platform Intellectual Property

All intellectual property rights in the Platform itself, including the software, user interface, templates, prompt systems, brand identity, and documentation, are owned by or licensed to CrownCity Technologies Ltd. These Terms do not grant you any rights in the Platform's intellectual property except the limited license to use the Platform as described herein.

You may use the Platform for lawful creative, commercial, educational, and personal purposes consistent with these Terms.

We employ automated and human review processes to detect violations of our Acceptable Use Policy. We reserve the right to remove any content that violates these Terms without notice and to suspend or terminate the accounts of users who violate these policies.

We operate a referral program allowing users to earn rewards for successfully referring new paying subscribers to the Platform. The referral program is subject to the following:

8.1 Platform Provided "As Is"

The Platform and all AI-generated content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties including:

• —Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• —Warranties that the Platform will be uninterrupted, error-free, or free of viruses.
• —Warranties regarding the accuracy, completeness, or cultural authenticity of any AI-generated content.

8.2 AI Content Disclaimer

AI-generated content may sometimes be inaccurate, offensive, or not fully reflect African cultural contexts despite our best efforts. You are responsible for reviewing all AI-generated content before use. We are not liable for any claims arising from your use of AI-generated content.

8.3 Limitation of Liability

To the maximum extent permitted by applicable law, CrownCity Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of the amount you paid to us in the 3 months preceding the claim, or GHS 500. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless CrownCity Technologies Ltd, its directors, employees, partners, agents, suppliers, and licensors from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:

• —Your use of the Platform in violation of these Terms.
• —Your violation of any applicable law or regulation.
• —Your infringement of any third party's intellectual property or other rights.
• —AI-generated content you create and publish using the Platform.
• —Any content you upload to the Platform as input.

10.1 By You

You may close your account at any time through Account Settings Close Account or by contacting support@fefefe.app. Closing your account does not entitle you to a refund of any remaining subscription period or credits, except as set out in our Refund Policy.

10.2 By Us

We reserve the right to suspend or terminate your account for:

• —Violation of these Terms or our Acceptable Use Policy.
• —Suspected fraud, abuse, or illegal activity.
• —Non-payment of subscription fees.
• —Extended inactivity (30 days' prior notice for free accounts).

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles.

11.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, collective action, or representative action.
